When receiving an assistive device, a contract is concluded between the client and VTPC or the service provider. It specifies the form in which the assistive device is handed over for use and the conditions of its use.
According to the Cabinet of Ministers regulations, technical aids can be provided:
in ownership - the assistive device becomes your property and does not need to be returned;
on loan - the assistive device remains state property, and you use it for a specified period;
for rent - the assistive device is provided for use based on a rental agreement.
The contract always specifies:
the type of assistive device,
the duration of use,
warranty and repair conditions,
the procedure for return or exchange.

When you receive a technical aid, you sign a contract with VTPC or the service provider.
The contract states how you receive the assistive device and how you should use it.
According to the Cabinet of Ministers regulations, the technical assistive device can be provided:
- **In ownership** – the assistive device is yours. You do not have to return it.
Example: you receive a cane, and it remains yours.
- **On loan** – the assistive device is state property. You use it for a specified period.
Example: you receive a wheelchair for 3 years, after which you must return or exchange it.
- **For rent** – you use the assistive device based on a rental agreement.
Example: you rent a lift and pay for it every month.
The contract always states:
- what the assistive device is,
- how long you are allowed to use it,
- what the warranty conditions are,
- how repairs are handled,
- how you return or exchange the assistive device.
Please read the contract carefully. It helps to use the assistive device safely and correctly.
Transfer of Assistive Device Ownership
Some assistive devices are transferred to the client’s ownership. In this case:
You become the owner of the assistive device,
the assistive device does not need to be returned to VTPC,
a transfer acceptance act is drawn up.
Assistive devices that are not practical to return or reuse are usually transferred to ownership.

This means:
- you become the owner of the assistive device
- the assistive device does not need to be returned to VTPC
- the employee and the client together sign the transfer acceptance act (this is a document that states which assistive device you are receiving)
Usually, assistive devices that are not practical to return or reuse are given in ownership.
For example, they are difficult to adapt for another person, or they wear out quickly.
Transfer of Assistive Device on Loan
Most technical aids are provided on loan (for free use). This means that:
the assistive device remains the property of the state,
you use it for a specified period,
after the term ends, it must be returned or exchanged,
a loan agreement and an acceptance-transfer act are signed.
If the loaned assistive device cannot be returned, there may be an obligation to cover its value to a certain extent (50–75%).
Transfer of Assistive Device for Use
Many technical aids are provided by the state for free use. This means:
- the assistive device is state property, not yours,
- you use the assistive device for a specified period,
- after this period ends, the assistive device must be returned or exchanged for another,
- you sign a contract for use and an act for receiving and transferring the assistive device.
If you cannot return the assistive device, you may be obliged to pay part of its value. Usually, this is half or slightly more than half of the full value.
Transfer of the technical assistive device for rent
In certain cases, the assistive device is rented out. Then:
a rental agreement is concluded,
the agreement specifies the rental period, usage conditions, and return procedure.

In some cases, the technical assistive device is rented out instead of being donated or assigned immediately.
Then the following occurs:
- a person and an institution or company conclude a rental agreement,
- the agreement states for how long the assistive device is provided,
- the agreement specifies how the assistive device may be used,
- the agreement states how and when the assistive device should be returned.
Renting is usually the case when the assistive device is expensive, special, or needed only for a short time.
For example, if a person needs a wheelchair for just a few months after surgery.
What is stated in the contract?
Regardless of the form of ownership, the contract always specifies:
the type, model, and value of the assistive device,
the usage period,
warranty and repair conditions,
usage rules,
the procedure for applying for a new assistive device,
obligations in case of return or exchange.

Purchase of Assistive Device
The assistive device received on loan can be purchased.
To do this:
you must ensure that the usage period specified in the loan agreement has expired,
you must submit an application to VTPC for the purchase of the assistive device.
Purchase price: 15% of the value of the assistive device.
After the purchase, the assistive device becomes your property.
Example:
If the value of the assistive device is 100 €, the purchase fee will be 15 €.
Purchase of Assistive Device
If you receive a technical aid on loan, you can later purchase it.
To purchase the assistive device:
1. Check that the usage period specified in the loan agreement has expired.
2. Submit an application to VTPC stating that you want to buy this assistive device.
The purchase price is a portion of the value of the assistive device.
This means: you pay only a small part of the full price.
After the purchase, the assistive device is your property.
Example:
If the assistive device costs 100 €, the purchase fee is 15 €.
When the assistive device automatically becomes your property
The assistive device received on loan becomes your property free of charge if:
it has been used for one and a half times longer than the term specified in the contract.
Example:
If the usage period specified in the contract is 3 years, after 4.5 years the assistive device automatically becomes your property.
No additional documents are required.
When the assistive device automatically becomes your property
The assistive device you receive on loan can become your property free of charge.
This happens if you use the assistive device longer than the time stated in the contract.
The rule is as follows:
if you use the assistive device 1.5 times longer than stated in the contract, it becomes your property.
Example:
if the contract states that the usage period is 3 years,
then after 4.5 years the assistive device is automatically yours.
You do not need additional documents.
